A form of pepper spray was used by police as part of an arrest.
During a routine patrol in Thames Street, Weybridge, a vehicle was stopped just after 10pm on Saturday, October 10.
A police spokesman said: "A man was arrested at the scene and during the course of the incident an officer was required to deploy Pava gas."
Pava gas is a synthetic form of pepper spray primarily affecting the eyes causing closure and pain.
It is used to lessen the resistance of a person but without prolonging the effect for longer than is necessary.
Following the incident, David Evans, 55, of Herons Croft, Weybridge, was charged with failing to provide a specimen and is next due to appear at Staines Magistrates' Court on November 5.
