VESTING DECLARATION
NOTICE IS HEREBYGIVEN that the London Borough of Barnet ("the Authority") on Thursday 16th July 2020 executed aGeneral Vesting Declaration under section 4ofthe Compulsory Purchase (Vesting Declarations) Act 1981 ('the Act') vesting the land ("the Land") and the new rights (" New Rights") described in the Schedule to this notice in themselves as from the end of the period of three months from the date on which service of the notices required by section 6 of the Act is completed. The effect of the general vesting declaration is as follows: The Land described in the Schedule hereto (being part of the land authorised to be acquired by the Order) and more particularly delineated in pink on the plan annexed hereto, together with the right to enter and take possession of the land shall vest in the Authority as from the first day after the end of the period of 3months from the date on which the service of notices required by section 6ofthe Act is completed. The New Rights in and over the land (more particularly delineated in blue on the plan annexed hereto) as described in the Schedule hereto (being the new rights authorised to be acquired by the Order), together with the right to enter in and take possession of the land in order to exercise the New Rights, shall vest in the Authority as from the first day after the end of the period of 3monthsfrom the date on which the service of notices required by section 6ofthe Act is completed.
Also, on the Vesting Date the Acts providing for compensation will apply as if,onthe date on which the General Vesting Declaration was made (namely,16th July 2020) anotice to treat had been served on every person on whom, under section 5ofthe Compulsory Purchase Act 1965, the Authority could have served such anotice (other than any person entitled to a"minortenancy" or a"long tenancy which is about to expire"). If the Land includes any land in which there is aminor tenancy or along tenancy which is about to expire, the right of entry will not be exercisable in respect of that land unless, after serving anotice to treat in respect of that tenancy,the Authority having served on every occupierofany of the land in which the tenancy subsists anoticestating that, at the end of a specified period (at least 3months from the date of the service of the notice) they intend to enter upon and take possession of the land specified in the notice, and that period has expired: the vesting of the land will then be subject to the tenancy until that period expires, or in the absence of such notice to treat, the tenancy comes to an end [by exercise of Landlord and Tenant powers], whichever happens first.
Schedule A(Part 1) and Schedule 1tothe Act contain supplementary provisions astogeneral vesting declarations. If acounter-notice is served under paragraph 2ofSchedule A(Part 1) within the period referred to in the first paragraph of this notice, the vesting date for the land which is the subject of the counter-notice will be determined in accordance with that Schedule.
