Drivers in Kingston are not rolling over and paying their fines for flouting bus lane regulations, according to figures released in a Freedom of Information request.
One bus lane in Eden Street, Kingston, has been enforced by the council since September 2009, in which time 900 cases have been appealed.
Of those 900 penalty charges, 74 were dropped after written appeal and five were referred to an independent adjudicator, of which one case was found against the council.
The Eden Street bus lane courted controversy recently when parking campaigners discovered a mistake in the wording of the council’s penalty charge notices.
Town centre busker Philip Morgan had a £120 fine for driving in the bus lane dropped last month, after he discovered the council’s demand did not adhere to the law.
The council has since changed the wording, but Mr Morgan believes wrongly-paid fines, before the correction, should be returned.
He said: “They should refund all the people. There are thousands of people who have been clobbered by just one word.”
